DMM DOCUPREP^TM

This Agreement for Services (“Agreement”) is entered into as of the date this online request is submitted by user (“User”) to DEFAULT MITIGATION MANAGEMENT LLC (“DMM”).

1. User desires to retain DMM to provide Document Assistance Services (as defined below).
2. DMM agrees to provide the following services (the “Document Assistance Services”):
   • DMM shall do the following:
     • Contact borrower using the contact information provided by User. If User is an attorney, User hereby authorizes contact with borrower and will instruct borrower that DMM will be contacting borrower on behalf of Attorney and ensure borrower’s cooperation.
     • Work with borrower to prepare the following documents as applicable (the “Loan Modification Documents”):
       1. Borrower Authorization (authorizing attorney’s representation of borrower in connection with borrower’s loan modification)
       2. HAMP Request for Modification and Affidavit
       3. Uniform Borrower Assistance Form
       4. Borrower Financial Statement
       5. Hardship Letter
       6. IRS Form 4506-C
       7. Dodd-Frank Certification
       8. Any proprietary servicer-specific forms of which DMM is aware
       9. Documentation required to document borrower’s income
     • Upon completion of borrower’s Loan Modification Documents, DMM will forward same to User for review and approval. If User advises DMM that there are any issues with the Loan Modification Documents, DMM shall use commercially reasonable efforts to cure such issues. User shall be responsible for completion of the loss mitigation review and shall deal directly with the servicer.
3. In consideration for the Document Assistance Services rendered by DMM, User will pay DMM $250.00 (the “Fee”). The Fee shall be due and payable immediately upon DMM’s delivery to the User of the Loan Modification Documents. For purposes of this Agreement, the Loan Modification Documents shall be deemed to be accepted by User unless User notifies DMM of any issues therewith within 3 business days of delivery.
4. If User is an attorney, DMM and User each acknowledge and agree that User is and shall remain in all aspects the borrower’s legal representative. In providing the Document Assistance Services, DMM will be acting under the supervision and guidance of User.
5. User shall deal directly with borrower’s mortgage servicer to finalize borrower’s loss mitigation review. User shall be responsible for any subsequent document requests. DMM is NOT providing any legal advice.

NOTICE TO USERS IN JURISDICTIONS THAT REQUIRE DOCUMODS

Some courts may require that prior to filing a motion to participate in the Court’s loss mitigation program, the debtor’s information must be submitted through the Court’s approved Document Preparation Software – docUmods™ (www.documods.com). DMM DocuPrep™ complies with this requirement by utilizing docUmods™ to prepare a client’s loss mitigation package. Accordingly, User will be able to certify to the Court that borrower has completed this process. The $250 fee for DocuPrep™ includes the $129 fee for docUmods™ - i.e., User will not need to pay a separate fee for docUmods™.
